These Terms and Conditions of Use set forth the terms and conditions that apply to your use of the New Jersey Lottery Website listed at www.njlottery.com and related web pages (the "Lottery Website"), the New Jersey Lottery Game Changers ("Game Changers") Website listed at www.njgamechangers.com and related web pages (the "Game Changers Website"), the New Jersey Lottery VIP Club ("VIP Club") web pages, and the New Jersey Lottery mobile application ("Mobile App") (the Lottery Website, Game Changers Website, VIP Club, and Mobile App are collectively referred to herein as the "Websites"). By downloading the Mobile App, creating a VIP Club Account and/or creating a Game Changers Account, and/or accessing, interacting with, submitting information or content to, browsing or using the Websites (collectively "Activities") in any way, whether or not specifically mentioned herein, you are consenting to and agreeing to comply with these Terms and Conditions of Use without limitation. If you do not agree to be bound by each of these Terms and Conditions of Use, you are requested to immediately refrain from the Activities, you are requested to immediately unsubscribe from or delete any account(s) you may have created on the Websites, including accounts created through the VIP Club, Game Changers and/or the Mobile App, and you are requested to immediately exit the Websites. By unsubscribing or deleting any such account(s) you will no longer be eligible to receive a prize in connection with any New Jersey Lottery promotion that you may have entered through such account(s) prior to your deletion of such account(s).  Your access to and/or use of the Websites is governed by all applicable federal, state and local laws. The Websites may only be used for lawful purposes. In the event of a conflict between these Terms and Conditions of Use and any state or federal laws, including the New Jersey Lottery Law and the New Jersey Open Public Records act, the state or federal laws will control.

The terms "you", "your" or "user" as used throughout these Terms and Conditions of Use refer to any natural person(s) and/or entity(ies) who may engage in any or all of the Activities for any purpose.

The terms "we", "our" and "Website Providers" as used throughout these Terms and Conditions of Use refer to the New Jersey Lottery, its agents, employees, officials, contractors and subcontractors, including but not limited to Northstar New Jersey Lottery Group, LLC ("Northstar") and Northstar's agents, employees, subcontractors, members and affiliates.

Age Restrictions

The Websites are directed to and intended to be used by individuals 18 years of age or older. Individuals under the age of 18 must not engage or participate in any of the Activities. By engaging or participating in any of the Activities, you represent and certify that you are at least 18 years of age and you are fully able and competent to enter into the terms, conditions, warranties and representations set forth herein.

Third Party Websites

The Websites provide links to other websites as a convenience to our users. These may include, for example, links to websites operated by other government agencies, nonprofit organizations, and private businesses. When you use one of these links, you are no longer on the Websites, and these Terms and Conditions of Use do not apply.

When you link to another website, you are subject to the terms, conditions and policies of that particular website. Any visitor who proceeds to those external sites and relies on any information obtained from them does so at his or her own risk and assumes any and all liability from damages which may result from accessing a third-party site linked to the Websites. The Website Providers exercise no control over the third-party organization's views, accuracy, copyright or trademark compliance, or the legality of the material contained on those websites, and do not sponsor, endorse, or approve the information, content, products, materials, opinions or services contained on such external sites. Furthermore, when you follow a link to another website, portions of the information contained on the external website may be incorrect or out of date. The Website Providers do not warrant the accuracy, reliability, or timeliness of any information published by any external websites or any product or service offered by external websites and we will not be a party to or in any way responsible for monitoring any transaction between you and any third-party providers of products or services on such external websites.

Information on the Websites should always be verified before you rely upon it. Official winning numbers for New Jersey Lottery draw games are those selected in the respective drawings and recorded under the observation of the New Jersey Lottery's independent accounting firm. In the event of a discrepancy between the official winning numbers for any draw game and the winning numbers identified on the Websites, the official winning numbers shall prevail. Official prize amount information for all New Jersey Lottery games is the prize amount information in the official records of the New Jersey Lottery. In the event of a discrepancy between the official prize amount information and the prize amount information identified on the Websites, the official prize amount information shall prevail. The contents of the Websites do not constitute, and are not intended to constitute, advice.

Indemnification

You agree through your engagement or participation in any of the Activities on or through the Websites to indemnify Website Providers and their respective officers, directors, members, employees, agents and affiliates from and hold harmless against any and all claims, damages, actions, liabilities, losses, expenses, and causes of action arising out of your use of the Websites, your participation or engagement in any of the Activities, your reliance upon any of the information on the Websites, your inability to access the Websites, and/or any breach by you of these Terms and Conditions of Use.

Trademarks and Copyrights

The Intellectual Property Rights in the Websites and the materials and content displayed on and from the Websites are owned by the Website Providers or their respective licensors. You may only use the Websites for their intended purpose. You may not use, reproduce, modify, create derivative works from, display, publish, distribute, transmit, broadcast or circulate any such materials or content displayed on or from the Websites to any third party without the express written consent of the Website Providers or their respective licensors, as applicable.

The term "Intellectual Property Rights" as used in these Terms and Conditions of Use includes but is not limited to any copyrights, trademarks, service marks, trade dress, trade names, logos, company names, service names, product names, trade secrets, and/or confidential information.

You are not permitted to use the New Jersey Lottery's name or logo for any purpose, commercial or otherwise, without receiving prior written approval.

New Jersey Lottery VIP Club

The VIP Club is a free service to members that offers, among other things, daily winning numbers results emails, coupons, New Jersey Lottery news and events, second chance entries, early notification of new games, promotions, jackpot alerts, surveys, and the chance to be entered into drawings for prizes ("VIP Club Communications"). By creating a VIP Club account and registering with the New Jersey Lottery, you may agree to receive VIP Club Communications by email, SMS and MMS text message to your phone, or other VIP Club Communications from the New Jersey Lottery. You will be permitted to opt-in to any or all of these VIP Club Communications by updating your VIP Club account settings on the Websites. You may opt-out of these communications by un-subscribing or requesting that the Website Providers delete your account. You are solely responsible for all activity on your VIP Club account and for the security of your computer system. You are also solely responsible for ensuring that the contact information that you provide for your VIP Club account is current and valid.

In order to become a member of the VIP Club, you will first be required to create an account and register with the New Jersey Lottery by providing specific information in the manner prescribed. Membership in the VIP Club is limited to persons who are 18 years of age or older. By submitting information to register for a VIP Club account, or to update an existing VIP Club account, you represent and certify that you are registering for an account or updating your existing account in your own name, that you are 18 years of age or older, that you are using your own personal information, and that your VIP Club account is personal to you and should not be used by any other person. You are solely responsible for maintaining the confidentiality of your password and VIP Club account and for any and all activities that may occur under your VIP Club account, regardless of whether you authorized such access or use. You agree to immediately notify us of any unauthorized use or suspected unauthorized use of your VIP Club account or any other breach of security in connection with your VIP Club account to which you become aware. The Website Providers will not be liable for any loss or damage that you may incur as a result of someone else using or accessing your password or lottery related account(s), either with or without your knowledge.

The Website Providers reserve the right to delete or close any VIP Club account at any time for any reason, including but not limited to, the existence of multiple accounts for one individual, or the inactivity of an individual's account for a period of time.

Any promotions or sweepstakes offered by the VIP Club will be governed by official rules for such promotion or sweepstakes and located on the VIP Club webpage.

Game Changers

Game Changers is a community that allows members to voice opinions, perspectives and experiences with the New Jersey Lottery and New Jersey Lottery products, offerings and initiatives; participate in surveys, promotions, sweepstakes and contests available only to the Game Changers community; and receive communications relating to New Jersey Lottery news, events, promotions and products (collectively "Game Changers Communications"). The aim of Game Changers is to better understand its members in order to help the New Jersey Lottery provide the best possible New Jersey Lottery experience to everyone. Whether Game Changers members are New Jersey Lottery players, or they just observe the New Jersey Lottery from afar, individuals who are 18 years or older can join Game Changers for free and participate in exciting opportunities to express their voice about the New Jersey Lottery.

Governing Law

These Terms and Conditions of Use shall be governed by and construed in accordance with the laws of the State of New Jersey without regard to conflicts of laws principles. You acknowledge and agree that any dispute arising out of or under these Terms and Conditions of Use shall be resolved exclusively in the state or federal courts of the State of New Jersey. You agree to submit to the personal jurisdiction and venue of the state and federal courts located in Mercer County, New Jersey.

Entire Agreement; Severability; Section Headings

These Terms and Conditions of Use constitute the entire agreement relating to the subject matter covered and supersede any prior agreements, arrangements, undertakings or proposals, written or oral, in relation to such matters. The invalidity of a part of these Terms and Conditions of Use will not affect the validity and enforceability of the remaining provisions. The section headings are for convenience only and do not have any force or effect.

Privacy

The New Jersey Lottery takes steps to protect the privacy of personal information submitted to the New Jersey Lottery through the New Jersey Lottery's Websites, but it in no way guarantees that any information or content you submit through the Websites will remain private. Please review the New Jersey Lottery Privacy Policy for more information. The Privacy Policy is incorporated into these Terms and Conditions of Use

Submissions

Any suggestions, ideas, or concepts that you submit through the Websites shall become, and remain, the property of the New Jersey Lottery. By submitting such suggestions, idea or concepts through the Lottery's Websites, you acknowledge and agree that the New Jersey Lottery has the right to use such material for any purpose as it sees fit.

Changes to these Terms of Use

The Website Providers reserve the right to update or revise these Terms and Conditions of Use at any time and without notice by posting new Terms and Conditions of Use at this location. Your continued access, interaction with, posting of content to, browsing, or use of the Websites and/or engagement in any Activities shall constitute your acknowledgement and acceptance of such new Terms and Conditions of Use.
